1. Purpose and Acceptance
1.1. These Terms and Conditions of Use ("Terms") govern access to and use of the MEDIA Rate platform, available at [domain], operated by END ART Studios ("we," "the Platform"), a [individual/company] registered under [tax ID], with registered address at [full address]. 1.2. By creating an account or using any feature of MEDIA Rate, you ("User") acknowledge that you have read, understood, and fully accepted these Terms, as well as our Privacy Policy, which is incorporated by reference into this document. 1.3. If you do not agree with any provision of these Terms, you should not create an account or use the Platform.
2. Definitions
- Platform: the MEDIA Rate website and applications, including all their features. - MEDIA Score™: a proprietary algorithm that aggregates ratings from public sources, displayed as a unified score per title. - Third-Party Content: data, images, and ratings obtained from external sources (e.g., TMDB, IGDB, and others listed on the "About" page), owned by their respective rights holders. - Subscription: a paid plan (Plus or Premium) that unlocks additional features, as described on the Pricing page. - Account: the personal, non-transferable registration created by the User to access the Platform.
3. Registration and Account
3.1. Registration requires accurate, complete, and up-to-date information. The User is solely responsible for the accuracy of the information provided. Minimum age: use of the Platform is intended for users aged 14 (fourteen) years or older. 3.3. Each User may maintain only one Account. Creating accounts on behalf of others without express authorization, or creating multiple accounts to circumvent free-plan limits, is prohibited. 3.4. The User is responsible for keeping their password confidential and for all activity occurring under their Account. Any suspected unauthorized use must be reported immediately. 3.5. Users may register via social login (Google, Apple), in which case they authorize sharing of the minimum information necessary (name, email) to create the Account.
4. Description of Services
4.1. MEDIA Rate is a media discovery and rating-aggregation platform (movies, series, games, and progressively books, comics, and manga) that: a) consolidates ratings from public sources into a unified score (MEDIA Score™), broken down between specialized critic and audience ratings where available; b) suggests related works across different media types (e.g., adaptations, sequels, shared universe); c) allows Users to organize their consumption history (status: "want to consume," "in progress," "completed," "abandoned") and record personal reactions. 4.2. MEDIA Rate does not host, distribute, transmit, or make available the underlying audiovisual, literary, or game content itself (films, episodes, full books, game sessions). The Platform deals exclusively with metadata and aggregated ratings. 4.3. Features may vary depending on the User's Subscription plan, as described on the Pricing page, subject to change upon prior notice under Clause 13. 4.4. Media categories marked as "coming soon" (e.g., Books, Comics, Manga, per the current roadmap) do not constitute a promise of availability by any specific date.
5. Plans and Payment
5.1. The Platform offers a free plan ("Free") and paid plans ("Plus" and "Premium"), with pricing and features detailed on the Pricing page, subject to change upon prior notice of 30 (thirty) days. 5.2. Payments are processed by a third-party provider (Stripe), subject to that provider's own terms. MEDIA Rate does not store full credit card data. 5.3. Prices are currently displayed and billed in Brazilian Reais (R$), as MEDIA Rate operates as a Brazilian entity. 5.4. Cancellation may be made at any time by the User via the Settings page, effective at the end of the current billing cycle, without pro-rated refund for the remaining period, except as otherwise required by applicable law. 5.5. A free trial period, when offered, automatically converts into a paid Subscription at the end of the trial, unless canceled beforehand by the User.
6. Intellectual Property
6.1. The MEDIA Score™ mark, visual identity, source code, scoring methodology, and other original elements of the Platform are the exclusive property of MEDIA Rate/END ART Studios, protected under applicable copyright and intellectual property law. 6.2. Without express written authorization, the User may not: a) reproduce, copy, distribute, or commercially exploit any original Platform content; b) reverse-engineer, scrape, or perform bulk data extraction from the Platform through unofficial means; c) use the MEDIA Score™ mark or any element of the Platform's visual identity outside the normal context of using the service. 6.3. Third-Party Content displayed on the Platform (synopses, images, source ratings) belongs to its respective rights holders and is used under license or permitted use of free public APIs, as listed on the "About" page. MEDIA Rate does not claim ownership of this content.
7. User Conduct
7.1. The User may not: a) post or transmit content that constitutes hate speech, discrimination, harassment, or incitement to violence; b) use the Platform to send spam, phishing, or any fraudulent practice; c) attempt to access restricted areas of the system, third-party accounts, or data that does not belong to them; d) artificially manipulate the MEDIA Score™ or any Platform metric; e) use bots, automated scripts, or any unauthorized means of interacting with the Platform; f) engage in any conduct that violates applicable law in the User's jurisdiction or the laws of Brazil, including Brazil's Marco Civil da Internet (Law No. 12.965/2014), which governs the Platform's operation. 7.2. Violation of this clause subjects the User to the measures set out in Clause 11 (Suspension and Termination of Account), without prejudice to applicable civil or criminal liability.
8. Third-Party Data Sources and Disclaimers
8.1. The MEDIA Score™ and other displayed information are calculated from data provided by public third-party sources. MEDIA Rate does not guarantee the accuracy, timeliness, or completeness of this data, which reflects information made available by the respective sources at the time of query. 8.2. Consumption decisions (watching, playing, reading) made based on the MEDIA Score™ are the User's sole responsibility. The Platform is not liable for any dissatisfaction with a recommended or rated work.
9. Limitation of Liability
9.1. The Platform is provided "as is," without warranty of uninterrupted availability, absence of errors, or fitness for any purpose not expressly described in these Terms. 9.2. To the maximum extent permitted by applicable law — noting that consumer-protection law in some jurisdictions (including Brazil's CDC) restricts the extent to which liability may be excluded in consumer relationships — MEDIA Rate's liability for direct damages demonstrably caused by a Platform failure is limited to the amount paid by the User in Subscription fees during the 12 (twelve) months preceding the event, where applicable. This clause does not override any non-waivable consumer rights under applicable law. 9.3. MEDIA Rate is not liable for unavailability caused by third-party failures (cloud providers, payment processors, external data APIs) outside its reasonable control.
10. Privacy and Data Protection
10.1. Processing of the User's personal data is governed by our Privacy Policy, prepared in accordance with Brazil's General Data Protection Law (Law No. 13,709/2018 — LGPD), incorporated by reference into these Terms. 10.2. Users located in the European Economic Area may have additional rights under the EU General Data Protection Regulation (GDPR), which can apply extraterritorially depending on how the Platform is marketed and used. 10.3. The User has the rights set out in LGPD Art. 18 (and, where applicable, GDPR), including confirmation of processing, access, correction, portability, and deletion of personal data, exercisable via the Account Settings page.
11. Suspension and Termination of Account
11.1. MEDIA Rate may suspend or terminate, temporarily or permanently, the User's access to the Platform, with notice when possible, in the following cases: a) violation of any provision of Clause 7 (User Conduct); b) providing false information during registration; c) non-payment of Subscription fees, after billing attempts; d) reasonable suspicion of fraud or use of the Account for unlawful purposes; e) court order or determination by a competent authority. 11.2. The User may terminate their own Account at any time via the Settings page, subject to Clause 5.4 regarding refunds. 11.3. Termination of the Account does not release the User from any outstanding financial obligations up to the termination date.
12. Communications
12.1. Official communications regarding these Terms will be sent to the email address registered by the User, deemed received 48 (forty-eight) hours after sending.
13. Changes to These Terms
13.1. MEDIA Rate may amend these Terms at any time by publishing the updated version on the Platform and notifying the User by email or in-service notice, with at least 30 (thirty) days advance notice for material changes. 13.2. Continued use of the Platform after the changes take effect constitutes tacit acceptance of the new Terms. If the User does not agree, they should terminate their Account before the effective date.
14. General Provisions
14.1. If any provision of these Terms is deemed invalid or unenforceable by a competent authority, the remaining provisions shall remain in full force. 14.2. Failure by either party to enforce any provision of these Terms does not constitute a waiver of the right to enforce it later. 14.3. The User may not assign or transfer their Account or rights under these Terms to third parties without prior written authorization from MEDIA Rate.
15. Governing Law and Jurisdiction
15.1. These Terms are governed by the laws of the Federative Republic of Brazil. 15.2. Any disputes arising from these Terms shall be submitted to the courts of [Osasco/SP — confirm current registered address], without prejudice to any non-waivable right the User may have, under their own local consumer-protection law, to bring proceedings in their place of residence.
